1. Eligibility and account registration

You may use the Services only if you are legally capable of entering into a binding agreement under applicable law.

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us promptly if you believe your account has been compromised or used without authorization.

2. Nature of the Services

Aaku provides a travel companion service designed to help users create, adapt, organize, and follow travel itineraries and receive planning and trip-related assistance.

Aaku is not:

• a travel agency;
• a booking platform;
• a transportation provider;
• a hotel provider;
• a tour operator;
• a navigation service replacement;
• an emergency service; or
• a guarantee of travel availability, timing, pricing, entry access, safety, suitability, or real-world conditions.

The Services may include AI-supported or automated outputs, trip recommendations, suggested itineraries, contextual travel guidance, summaries, or other informational content. These are provided for general informational and organizational purposes.

3. No professional, safety, or emergency advice

Aaku does not provide legal, medical, safety, immigration, insurance, or other professional advice.

You are solely responsible for making your own travel decisions, verifying critical details, and using independent judgment. This includes checking matters such as:

• opening hours;
• local closures;
• ticket or reservation requirements;
• transport availability;
• weather conditions;
• local laws and regulations;
• health and safety advisories;
• accessibility conditions; and
• suitability for you and your travel party.

Do not rely on the Services as your sole source for urgent, emergency, or safety-critical information.

4. AI-generated and user-reviewed outputs

The Services may generate itineraries, recommendations, travel summaries, proposed trip changes, and similar outputs using automated systems and AI-supported functionality.

These outputs may be incomplete, inaccurate, outdated, unavailable, or unsuitable for your situation. You are responsible for reviewing all outputs before acting on them.

By using the Services, you acknowledge that:

• AI-generated content may contain errors;
• real-world travel conditions change frequently;
• recommendations may not reflect live availability or all relevant constraints; and
• you remain responsible for confirming information before relying on it.

5. Permissions and device features

Certain features may require access to device capabilities or permissions, such as location, notifications, microphone, camera, photos, or storage.

You may control many permissions through your device settings. If you deny certain permissions, some features may not function properly.

You acknowledge that location-aware features depend on device settings, signal quality, and other external factors, and may not always be accurate or available.

6. Acceptable use

You agree not to, and not to assist or enable others to:

• use the Services in violation of applicable law or regulation;
• infringe or violate the rights of others;
• upload, submit, or distribute content that is unlawful, harmful, abusive, defamatory, obscene, fraudulent, misleading, or infringing;
• interfere with or disrupt the Services or servers;
• attempt to gain unauthorized access to accounts, systems, or data;
• probe, scan, or test system vulnerabilities without authorization;
• introduce malware, viruses, or other harmful code;
• scrape, copy, harvest, index, or extract data from the Services using automated means except as permitted by us;
• reverse engineer, decompile, or attempt to derive source code except where prohibited by law;
• use the Services to build a competing product or service in a manner not permitted by law;
• impersonate any person or entity or misrepresent your affiliation;
• submit sensitive personal data of others without lawful basis or permission; or
• use the Services in a way that could create unreasonable risk, legal exposure, or harm for Aaku, users, or third parties.

7. Your content

You may submit, upload, import, create, or store content through the Services, including trip details, preferences, notes, prompts, text, screenshots, itinerary edits, and related materials ("User Content").

You retain ownership of your User Content, subject to the rights you grant below.

You grant Aaku a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, modify, display, transmit, and otherwise use User Content as reasonably necessary to:

• operate the Services;
• provide requested functionality;
• generate and display itineraries and trip outputs;
• improve service reliability and safety;
• prevent abuse; and
• comply with legal obligations.

You represent and warrant that:

• you have all rights necessary to provide the User Content;
• your User Content does not violate applicable law or the rights of others; and
• you have obtained any required permissions before submitting information about other people.

8. Our Services and content

The Services, including software, design, branding, interfaces, text, graphics, compilations, and other content provided by Aaku, are owned by or licensed to Aaku and are protected by applicable intellectual property and other laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal or internal business use, depending on the plan or offering made available to you.

Except as expressly permitted, you may not copy, modify, distribute, sell, lease, publicly display, publicly perform, or create derivative works from the Services.

9. Feedback

If you provide suggestions, ideas, comments, or feedback about the Services ("Feedback"), you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and otherwise exploit that Feedback for any lawful purpose without compensation or restriction.

10. Third-party services

The Services may interoperate with or link to third-party services, such as maps, identity providers, communication tools, travel information sources, app stores, or other third-party products.

We do not control third-party services and are not responsible for their availability, accuracy, content, terms, or privacy practices.

Your use of third-party services is at your own risk and subject to the terms and policies of those third parties.

11. Paid features and future billing

Some Services may be offered for free, while others may require payment now or in the future.

If paid subscriptions, premium features, or in-app purchases are introduced, additional pricing and billing terms may apply and will be presented to you at the time of purchase.

Unless otherwise stated, fees are non-refundable except as required by applicable law.

12. Suspension and termination

We may suspend, restrict, or terminate your access to the Services, in whole or in part, at any time, with or without notice, if:

• you violate these Terms;
• we reasonably suspect fraud, abuse, or unlawful activity;
• your use creates risk or harm to Aaku, users, or third parties; or
• we are required to do so by law.

You may stop using the Services at any time.

We may also modify, suspend, or discontinue any part of the Services at any time, with or without notice, subject to applicable law.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

AAKU DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, RELIABILITY, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WITHOUT LIMITING THE FOREGOING, AAKU DOES NOT WARRANT THAT:

• ANY ITINERARY, RECOMMENDATION, OR OUTPUT WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE;
• ANY LOCATION-BASED FEATURE WILL BE PRECISE OR AVAILABLE;
• ANY PLACE, VENUE, ROUTE, EXPERIENCE, OR SERVICE WILL BE OPEN, SAFE, ACCESSIBLE, OR AVAILABLE;
• ANY TRIP CAN OR SHOULD BE FOLLOWED EXACTLY AS DISPLAYED; OR
• THE SERVICES WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AAKU AND ITS AFFILIATES, FOUNDERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF AAKU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID TO AAKU FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
• ONE HUNDRED U.S. DOLLARS (US $100).

The limitations in this section apply regardless of the theory of liability and even if a limited remedy fails of its essential purpose.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Aaku and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

• your use of the Services;
• your User Content;
• your violation of these Terms;
• your violation of applicable law; or
• your infringement or violation of any rights of a third party.

16. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to conflict of law principles.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Ghaziabad, Uttar Pradesh, India, unless applicable law requires otherwise.

17. Changes to the Services and Terms

We may update the Services and these Terms from time to time.

If we make material changes to these Terms, we may provide notice by posting the updated Terms, updating the effective date, or providing additional notice where appropriate.

Your continued use of the Services after the updated Terms become effective means you agree to the revised Terms, to the extent permitted by law.

18. App store terms

If you download the mobile app through Apple's App Store or Google Play, you acknowledge that:

• these Terms are between you and Aaku, not with Apple or Google;
• Apple and Google are not responsible for the Services or their content;
• your use of the app must comply with applicable app store terms; and
• to the extent permitted by applicable law, Apple and Google are third-party beneficiaries of these Terms only as necessary to enforce rights relating to the app distribution terms.

19. General terms

If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision is not a waiver of our right to do so later.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets, or by operation of law.

These Terms, together with our Privacy Policy and any additional terms presented to you, constitute the entire agreement between you and Aaku regarding the Services.
